Kihlakunnanoikeus on, samalla kun A tuomittiin rangaistukseen, paitsi muusta, väkijuomien luvattomasta valmistamisesta, tuominnut A:n menettämään valtiolle tämän väkijuomien luvattomaan valmistukseen käyttämän muuripadan arvon.

Hovioikeus, jonne A valitti, katsoi, että koska sanottu muuripata oli A:n saunarakennukseen muuraamalla yhdistetty ja esitutkinan suorittaneiden viranomaisten toimesta jätetty paikalleen, A:ta ei voitu VäkijL 78 §:n 4 momentin eikä muunkaan säännöksen nojalla tuomita menettämään kyseisen muuripadan arvoa, sekä sen vuoksi poisti kihlakunnanoikeuden tästä menettämisseuraamuksesta antaman lausunnon lakiin perustumattomana.
