Koska virallisen syyttäjän maksuttomasta oikeudenkäynnistä annetun lain 10 §:n mukaan tuli valvoa, että edellytykset maksuttoman oikeudenkäynnin jatkamiselle ovat olemassa, eikä niin olleen oikeudenkäymiskaaren 15 luvun 3 §:n 1 momentin nojalla kaupunginviskaalia voitu määrätä vastaajan oikeudenkäyntiavustajaksi testamentin moitejutussa, on tätä koskeva pyyntö hylätty ja määrätty toinen henkilö oikeudenkäyntiavustajaksi.
