Administrative court dismissed appeal because ending involuntary care does not fall under Mental Health Act s. 24(2).
Legislator summary
AI generatedThe Administrative Court dismissed the appeal against the Social Services and Welfare Centre's decision to terminate involuntary psychiatric care. The appellant argued for a review under the Mental Health Act, but the court found the decision concerned the cessation rather than the initiation of care. Consequently, the appeal was inadmissible as it did not target the specific type of decision covered by the relevant statutory provision.
