Oikeusaputoimisto oli muuttanut aikaisempaa oikeusapupäätöstä siten, että esitettyä avustajaa ei ollut määrätty oikeusapulain 8 §:n mukaiseksi avustajaksi asiaan. Oikeusaputoimiston mukaan avustajaksi esitetty avustaja ei ollut täyttänyt oikeusapulain 8 §:n mukaisia vaatimuksia. Avustaja ei ollut asianajaja eikä luvan saaneista oikeudenkäyntiavustajista annetussa laissa tarkoitettu oikeudenkäyntiavustaja.
