Court dismissed appeal; shooting range permit stays with municipal board despite cross-border impact.
Legislator summary
AI generatedThe Administrative Court dismissed the applicant's appeal regarding the jurisdiction over a shooting range environmental permit. Although the applicant argued that significant environmental impacts extended beyond the municipality, the court found the Environmental Protection Act's allocation of authority between the municipality and the regional board to be exhaustive. Consequently, the court ruled that the municipal environmental protection board retained the exclusive right to decide on the permit.
Legislator headnote
AI generatedYmpäristönsuojelulaki 31 § 4 momentti; Ympäristönsuojeluasetus 7 §: The statutory division of authority between the municipal environmental protection board and the regional board is exhaustive; a permit designated for the municipal board cannot be transferred to the regional board merely because the site's impacts extend beyond the municipality.

Ympäristönsuojeluasetuksen 5 ja 7 §:ssä on ympäristönsuojelulain 31 §:n 4 momentin valtuutussäännöksen nojalla tyhjentävästi säädetty toimivallan jaosta lupaviranomaisten kesken.
Koska ampuraradan ympäristöluvat on ympäristönsuojeluasetuksella säädetty kunnan ympäristönsuojelulautakunnassa ratkaistavaksi, lupahakemusta ei voitu siirtää aluehallintoviraston ratkaistavaksi sillä perusteella, että sijaintipaikasta johtuen sen vaikutukset kohdistuisivat huomattavassa määrin sijaintikuntaa laajemmalle alueelle.
