Administrative court allows reindeer reduction by percentage of herd size as legally compliant method.
Legislator summary
AI generatedThe Administrative Court of Finland allowed the Sami reindeer herding community's decision to reduce reindeer by a percentage of the remaining herd rather than strictly by the previous year's quota. The community argued this method ensures proportional reduction among partners, while the opposing party contended it violated the mandatory herd-size ratio requirement. The court ruled that the statutory requirement for proportional reduction is satisfied by any method that maintains the relative share of each partner's herd.

Asiassa oli kysymys poronhoitolain 22 §:n 1 momentissa tarkoitetusta porojen pakollisesta vähentämisestä, jonka tulee tapahtua paliskunnan osakkaiden porojen määrän mukaisessa suhteessa.
Vähennettävien porojen määrä oli paliskunnassa aikaisemmin laskettu prosenttiosuutena kunkin poronomistajan edellisen poronhoitovuoden poroluettelon mukaisesta eloporoluvusta.
Poronhoitovuoden 2012 - 2013 osalta paliskunta päätti, että vähennettävien porojen määrä lasketaan prosenttiosuutena erotuksessa aitaan tulleista poroista. Hallinto-oikeus katsoi, että myös paliskunnan päättämällä tavalla suoritettu porojen vähentäminen tapahtuu poronhoitolain edellyttämällä tavalla osakkaiden porojen määrän mukaisessa suhteessa.
