ELY-keskus oli peruuttanut yhtiön taksiluvan neljän kuukauden ajaksi, koska liikenteestä vastaava henkilö X oli tuomittu 60 päivän ehdolliseen vankeusrangaistukseen laittomasta uhkauksesta, pahoinpitelystä ja huumausainerikoksesta.
Hallinto-oikeus hylkäsi valituksen siltä osin kuin kysymys oli X:n sopivuudesta taksiliikenteestä vastaavaksi henkilöksi. Hallinto-oikeus kumosi kuitenkin ELY-keskuksen päätöksen ja palautti asian ELY-keskukselle uudelleen käsiteltäväksi. Taksiluvan haltijana oleva osakeyhtiö voi vaihtaa liikenteestä vastaavan henkilön, eivätkä X:n teot liittyneet yhtiön toimintaan. ELY-keskus ei siten voinut peruuttaa yhtiön taksilupaa varaamatta ensin yhtiölle tilaisuutta vaihtaa liikenteestä vastaavaa henkilöä.
