The Administrative Court dismissed the taxpayer's request to apply the six-month foreign income exemption rule for 2012. The taxpayer moved to the US for work but took maternity leave in September 2012, during which time the family resided abroad. The court ruled that the exemption requires the stay abroad to stem from the taxpayer's own work, which ceased upon the start of maternity leave, leaving the work-related period under six months. Consequently, the court held that maternity leave does not constitute an unforeseen reason justifying the application of the exemption.

Legislator headnote

AI generated

Ennakkoperintälaki 18 §; Tuloverolaki 77 §: The six-month foreign income exemption rule applies only when the stay abroad is directly caused by the taxpayer's own employment, excluding periods of family relocation or statutory leave unrelated to work.

Päätöslyhennelmä

A:n haettua muutosverokorttia oli ennakkoperinnässä tehty ratkaisu, ettei hänen vuonna 2012 Yhdysvalloissa maksettavaan ulkomaan palkkatuloonsa sovelleta kuuden kuukauden sääntöä.

A vaati, että muutosverokortin laskennassa on sovellettava kuuden kuukauden sääntöä.

A muutti Yhdysvaltoihin 12.7.2012 työskennelläkseen suomalaisen tutkimuskeskuksen lähetettynä työntekijänä. A ilmoitti myös puolisonsa työskentelevän Yhdysvalloissa. Molempien työ tuli ilmoituksen mukaan kestämään Yhdysvalloissa 30.6.2014 saakka. A:n palkan maksaisi ulkomaantyöskentelyn ajalta suomalainen työnantaja. A:n työ keskeytyi äitiysloman alkaessa 28.9.2012. A ilmoitti olevansa Yhdysvalloissa koko äitiysloman ajan lukuun ottamatta parin viikon lomaa Suomessa vuonna 2013.

Hallinto-oikeus hylkäsi A:n valituksen.
