A:lla ei ollut opiskelun perusteella myönnetyn, 15.9.2008 - 15.9.2009 voimassa olleen oleskelulupansa aikana ollut lainkaan tutkinto-opintoihin ammattikorkeakoulussa liittyviä opintosuorituksia. Ensimmäinen merkintä hyväksytystä opintosuorituksesta oli tehty opintosuoritusrekisteriin 10.12.2009, ja A:lla oli 1.6.2010 mennessä ollut opintosuorituksia yhteensä 56 opintopisteen edestä. A ei ollut esittänyt sellaisia seikkoja, joiden perusteella hänen opiskelunsa voitiin katsoa ensimmäisen oleskeluluvan voimassaoloaikana kokonaan estyneen. Edellä mainitut seikat huomioon ottaen poliisilaitos oli voinut hylätä A:n hakemuksen jatko-oleskeluluvan myöntämisestä opiskelun perusteella.

KHO:n päätös 21.3.2011 taltionumero 733. Valituslupahakemus hylätään.
