Liikenneviraston ja eri jäänmurtotoimintaa harjoittavien yritysten välisiin jäänmurtosopimuksiin sisältyviä hintatietoja pidettiin kyseisten yritysten ja Liikenneviraston liikesalaisuuksina, joista muutoksenhakijalla ei ollut oikeutta saada tietoa jokaiselle kuuluvan tietojensaantioikeuden nojalla.

Muutoksenhakija ei ollut jättänyt tarjousta jäänmurtotoiminnasta eikä muutoksenhakija muullakaan perusteella pyytänyt jäänmurtosopimuksiin sisältyviä hintatietoja julkisuuslain 11 §:ssä säädetyn asianosaisen tietojensaantioikeuden nojalla.
