The Administrative Court of Finland dismissed the applicant's appeal against the licensing authority's decision to reduce the maximum number of tax licenses. The authority had initially set a quota of 1,432 licenses but later reduced it to 95 due to changed economic conditions. The court ruled that since the traffic need assessment forming the basis of the quota was binding upon the authority's approval, the authority could not unilaterally lower the quota during the subsequent licensing round. Consequently, the reduction was deemed legally impermissible as it violated the binding nature of the prior assessment. The applicant's argument that economic changes justified the reduction was rejected because the statutory framework required adherence to the originally assessed traffic needs.

Taksiliikennelaki 19 § (217/2007); Taksiliikennelaki 20 § (217/2007): Once the licensing authority approves an assessment of traffic needs as the basis for the maximum number of licenses, that assessment becomes binding, preventing the authority from reducing the license quota in subsequent licensing rounds based on economic factors.

PÄÄTÖSLYHENNELMÄ

Lääninhallitus oli vahvistanut alueen henkilöautolupien enimmäismääräksi 1 432 lupaa. Tämän kiintiöpäätöksen mukaisesti uusia lupia olisi lupakierroksella voitu myöntää 130. Lääninhallitus katsoi kuitenkin taloudellisten suhdanteiden muuttuneen sikäli merkittävästi, että uusia lupia voitiin myöntää vain 95 toimialan yleisen kannattavuuden vaarantumatta.

Taksilupien enimmäismäärän pohjana oleva liikennetarpeen arviointi oli tehty sitovasti lääninhallituksen vahvistamispäätöksellä. Varsinaisia taksilupahakemuksia ratkaistessaan lääninhallitus ei siten voinut enää vähentää taksilupien kiintiön mukaista enimmäismäärää.
