Toimeentulotuen hakija oli hyväksytty työvoimapoliittiseen koulutukseen tarkoituksenaan jatkaa aiemmin keskeytyneitä korkeakouluopintojaan. Opiskelu edellytti, että hakija kirjautuu korkeakouluun uudelleen ja liittyy ylioppilaskunnan jäseneksi. Toimeentulotukea haettiin tästä aiheutuviin maksuihin. Lautakunta hylkäsi hakemuksen, koska hakija voi kattaa kyseiset menot hänelle maksettavalla ylläpitokorvauksella.

Hallinto-oikeus palautti asian lautakunnalle uudelleen käsitelväksi. Opintojen jatkaminen työvoimapoliittisena koulutuksena on edellyttänyt kyseisten maksujen maksamista. Hakijalla on siten oikeus saada maksuihin täydentävää toimeentulotukea, mikäli toimeentulotuen myöntämisen edellytykset muutoin täyttyvät.
