The Administrative Court dismissed the taxpayer's appeal regarding the inheritance tax exemption on land sold to their son. Although the spouses had ceased active farming and rented out the fields to outsiders, the court found the rental income was correctly classified as agricultural income. The court ruled that the exemption applies because the sellers had historically farmed the land and the son inherited the fixed assets, regardless of the immediate cessation of active farming.

Puolisot olivat viljelleet tilaansa yli kymmenen vuotta, mutta isännän invalidisoitumisen johdosta antaneet tilan pellot vuokralle 1.3.2000 ulkopuoliselle. Peltojen vuokrauksesta saatu tulo oli verotettu maatalouden tulona. Puolisot myivät maatilan pojalleen 22.12.2003. Pellon osalta luovutusvoitto katsottiin verovapaaksi.

Veroasiamies oli vaatinut pellon luovutusvoiton verottamista, koska puolisot eivät enää useaan vuoteen olleet aktiivisesti viljelleet tilaansa eikä sukupolvenvaihdoshuojennus voinut koskea tilannetta, jossa tilan pellot on vuokrattu ulkopuoliselle.

Asiassa on äänestetty.
