Sosiaalilautakunnalla ei ollut oikeutta käyttää henkilölle hallinto-oikeuden lainvoimaisella päätöksellä heinäkuulta maksettavaksi määrättyä toimeentulotukea hänelle syyskuulta maksetun toimeentulotuen takaisinperintään kuittaamalla, koska kunnan oikeus takaisinperintään oli, kun sitä koskevaa hallintoriitaa ei ollut vireillä hallinto-oikeudessa, edelleen riitainen eikä henkilö ollut suostunut saatavien kuittaamiseen.
