Tax loss carryforward allowed only if current year profit remains after deducting prior year loss.
Legislator summary
AI generatedThe Administrative Court allowed the taxpayer's claim to deduct a 2001 capital loss against 2002 gains. The court held that the Tax Act permits such deduction only when the current year's potential losses are exhausted, leaving a net profit. Consequently, the 2001 loss was validly applied to the 2002 year because the 2002 transactions resulted in a net profit after offsetting any 2002 losses.

A:lle oli verovuodelle 2001 vahvistettu arvopaperien luovutustappiota.
