Kaupunki ja A olivat solmineet perhehoitajalain mukaisen toimeksiantosopimuksen.

A:n valitus koski sopimukseen sisältyvää kulukorvausta, lomatukea ja palkkion maksamista vapaan ajalta hoidon järjestämisestä. Hallinto-oikeus otti asian tutkittavaksi hallintoriita-asiana. Perhehoitajalain mukaista toimeksiantosopimusta pidettiin näiltä osin julkisoikeudellisena sopimuksena.
