Legislator summary

The Administrative Court upheld the decision to continue involuntary psychiatric hospitalization for the patient, M, despite the hospital director's ruling being issued after the statutory six-month deadline expired. Although the decision was made late, the court found no significant change in M's mental condition that would justify discontinuing the treatment. Consequently, the court ruled that the procedural delay did not invalidate the substantive requirements for continued involuntary care under the Mental Health Act.

Legislator headnote

Mielenterveyslaki 8 § 1 mom; Mielenterveyslaki 17 § 2 mom: A procedural delay in renewing an order for involuntary psychiatric hospitalization beyond the statutory period does not automatically terminate the treatment if the legal conditions for continuation remain satisfied and no significant change in the patient's condition has occurred.
