Administrative court rejects appeal for jurisdiction based on foreign office not being a nationwide authority under the Administrative Procedure Act.
Legislator summary
AI generatedThe Administrative Court of Helsinki dismissed the appeal regarding the jurisdiction of the Foreign Affairs Agency's New York office. The appellant argued that the office should be treated as a nationwide authority under Section 12(2) of the Administrative Procedure Act, thereby requiring the appeal to be heard in Kuopio. The court held that the foreign office does not meet the statutory definition of a nationwide authority, so the appeal correctly belongs to Helsinki where the Ministry is located.

Henkilö, jonka kotipaikka oli Kuopion hallinto-oikeuden
tuomiopiirin alueella, valitti saamansa muutoksenhakuohjauksen
mukaisesti Helsingin hallinto-oikeuteen Suomen
New Yorkissa olevan edustuston avustusasiassa tekemästä
päätöksestä. Valituksen johdosta tehdyssä päätöksessä katsottiin,
ettei ulkoasiainhallinnon organisaation kuuluvaa
ulkomaan edustustoa ole pidettävä hallintolainkäyttölain
12 §:n 2 momentissa (433/1999) tarkoitettuna viranomaisena,
jonka toimialueena on koko maa. Tämän vuoksi valitus on
tullut tehdä hallintolainkäyttölain 12 §:n 1 momentin mukaisesti
Helsingin hallinto-oikeudelle, jonka tuomiopiirissä
ulkoasiainhallinnon viranomaisten päätoimipaikka eli
ulkoasiainministeriö sijaitsee.
