Court allows delay in coastal protection works before water discharge increase if not unreasonably delaying the project.
Legislator summary
AI generatedThe Administrative Court allowed the Water Authority to delay coastal protection works until after increasing the water discharge capacity. The Authority argued that performing protection first would unreasonably delay the project, while the opposing party contended that protection should precede the discharge increase to prevent damage. The court ruled that since the delay was not unreasonable and the protection was necessary, the established order of operations did not need to be followed in this specific instance.

VEO oli määrännyt voimalaitoksen rakennusvirtaaman nostamisluvassa,
että rantojen suojaustyöt oli tehtävä ennen rakennusvirtaaman
nostamista.
VYO ei muuttanut tältä osin VEO:n päätöksen lopputulosta. VL
11:14a,2:n mukaan rahakorvaus on pääsääntöisesti suoritettava
ennen korvausvelvollisuuden aiheuttavaan toimenpiteeseen ryhtymistä.
VYO katsoi, että rannan suojaukseen, jolla estettiin
toimenpiteestä aiheutuvan vahingon syntyminen, oli periaatteessa
sovellettava samaa järjestystä. Rantojen suojaaminen
