Child born abroad to Finnish father and foreign mother denied Finnish citizenship due to lack of residence permit.
Legislator summary
AI generatedThe Administrative Court dismissed the application for Finnish citizenship for a child born in Russia to a Finnish father and a foreign mother. Although the child resided with the father in Finland, the court found no valid residence permit, meaning the stay did not meet the statutory requirements for automatic citizenship under the Nationality Act. Consequently, the court ruled that the citizenship could not be granted based on the child's residence alone.
Legislator headnote

Kansalaisuudeltaan suomalaisen isän ja venäläisen äidin
avioliiton ulkopuolella Venäjällä 14.9.1996 syntynyt lapsi
oli suntyessään saanut Venäjän kansalaisuuden. Lapsella oli
14.10.1996 lähtien ollut tilapäinen osoite Suomessa, jossa
hän oli tosiasiallisesti asunut isänsä luona. Koska lapsella
kuitenkaan ei ollut viisumia eikä oleskelulupaa hänen
asumistaan täällä ei voitu pitää kansalaisuuslain 3 a §:n
3 kohdassa tarkoitetulla tavalla pysyvänä. Lainkohdassa säädetty
edellytys sille, että lapsi olisi saanut Suomen kansalaisuuden
ilmoituksesta, ei siten täyttynyt. Äänestys 2-1.
