Court dismissed VAT exemption claim for foot care firm lacking regional health authority license despite having licensed staff.
Legislator summary
AI generatedThe Administrative Court dismissed the appeal regarding a VAT exemption claim by a sole proprietorship providing foot care services. Jalkojenhoitoa harjoittava kommandiittiyhtiö oli toiminnan
harjoittajana yksityisestä terveydenhuollosta annetussa
laissa (152/90) tarkoitettu palvelun tuottaja. Koska yhtiöllä
ei ollut lääninhallituksen lupaa terveydenhuollon
palvelujen antamiseen, yhtiön tuottama hoito ei ollut arvonlisäverotonta
terveydenhuoltoa. Näissä olosuhteissa ei
ollut merkitystä sillä seikalla, että yhtiön vastuunalaisena
yhtiömiehenä ja töiden suorittajana oli rekisteröity
terveydenhuollon ammattihenkilö. Äänestys 2-1.
