Oikeuskysymyksenä oli maa-aineslain 19 §:n 2 momentissa

säädetyn ilmoitusvelvollisuuden merkitys valitusajan alkamiselle.

P:n kunnanhallitus oli laiminlyönyt em. lainkohdassa säädetyn

ilmoitusvelvollisuuden maa-aineslupaa koskevassa asiassa,

vaikka valittaja A oli pyytänyt ilmoittamaan luvan myöntämisestä.

A:n valitus, joka oli myöhässä laskettuna päätöksen 17.3.1998

tapahtuneesta julkipanosta jätettiin tutkimatta eikä ilmoitusvelvollisuuden

laiminlyönnillä ollut asiassa merkitystä.
