A oli saanut toistuvasti toimeentulotukea. A:n entiseltä vaimoltaan

ajalta 1.1.1998-31.12.2000 kuukausittain saama 608

markan määräinen perusteettoman edun palautuserä oli luettu

A:n tuloksi toimeentulotuen tarvetta arvioitaessa.

A vaati muuttamaan lautakunnan päätöstä siten, että sanottu

määrä poistetaan tulona huomioon otetusta määrästä.

Lisäksi A vaati, että hänelle myönnetään maksuton oikeudenkäynti

ja määrätään avustaja.

Lääninoikeus myönsi A:lle maksuttoman oikeudenkäynnin ja määräsi
