Legislator summary

AI generated

The Administrative Court dismissed the appeal against a decision refusing a building permit for a pier and dredging project on a beach co-ownership area. The applicant argued the project would hinder the area's use, while the court held that determining whether the project exceeds the co-owners' usage rights belongs exclusively to the Water Court. Consequently, the Administrative Court removed the co-owners' rights assessment from the building permit decision and returned the case for further examination.

Legislator headnote

AI generated

Building Act 123 f; Water Act: The right of use belonging to a beach co-ownership area limits the scope of water law usage rights, and the Water Court has exclusive jurisdiction to examine if a project exceeds the co-owners' rights or violates their equality, which falls outside the building permit authority's scope.

VEO oli hylännyt hakemuksen luvan saamisesta laiturin rakentamiseen

ja venealtaan ruoppaamiseen rantakaavassa rakennuslain

123f ):n nojalla perustetulle rantaosakkaiden yhteiskäyttöalueelle

muun ohella sillä perusteella, että hanke

vaikeuttaisi ja osin estäisi yhteiskäyttöalueen käyttämisen

rantakaavassa määrättyyn tarkoitukseen ja että yhteiskäyttöalue

eräiden oikeuksien osalta menettäisi merkityksensä oikeuden

haltijoille.

Samalla kun VYO muulla perusteella palautti asian VEO:lle uudelleen

käsiteltäväksi, VYO poisti VEO:n päätöksestä rantakunnan

osakkaiden oikeuksia koskevan lausuman.

VYO totesi, että rantakunnalle mainitun säännöksen mukaan

kuuluva käyttöoikeus rajaa myös vesilain mukaisen käyttöoikeuden

laajuuden eikä hakijayhtiöllä, joka oli perustettu

omistamaan ja hallitsemaan yhteiskäyttöaluetta, ollut alueella

laajempaa oikeutta. Sen vuoksi vesituomioistuimen toimivaltaan

kuuluu viran puolesta tutkia, ettei hanke ole laajempi

kuin kaavan mukainen käyttötarkoitus edellyttää tai muuten

ilmeisesti käyttötarkoituksen vastainen. Samoin vesilain

mukaisessa lupaharkinnassa tulee vesilain 2 luvun 6 ):n mukaan

ottaa hankkeen hyötyä arvioitaessa huomioon, onko ja

missä määrin hanke tarpeellinen yhteiskäyttöalueen järkiperäistä

hyväksikäyttöä varten. Sen sijaan sen tutkiminen,

loukkaako hanke jonkun osakkaan oikeutta tai osakkaiden yhdenvertaisuutta,

ei rakennuslain 123f ):n sekä yksityisistä

teistä annetun lain 64 ja 70 ):n säännökset huomioon ottaen

kuulu vesituomioistuimen toimivaltaan.
