Legislator summary
AI generatedThe Administrative Court ruled that accrued pension interest must be taxed as income, not capital gains. X:lle oli maksettu takautuvasti tapaturmavakuutuslain
(608/48) mukaista eläkettä ja päivärahaa, joita oli mainitun
lain 60 a §:n mukaisesti korotettu suoritusten viivästymisen
johdosta. X vaati korvausten korotusosien verottamista
pääomatulona. Korotusten ei katsottu olevan korkoa
tai muuta siihen rinnastettavaa hyvitystä sijoitetulle
pääomalle, minkä vuoksi korvaukset katsottiin myös korotusosien
osalta ansiotuloksi. Verovuosi 1994.
