VAT liability applies to individual units in a joint-stock company, not the building itself.
Legislator summary
AI generatedThe Administrative Court ruled that a joint-stock company must be treated as a taxable person for VAT purposes regarding individual units rather than the entire building. The company argued it could not be liable for the transfer of empty parts of the property, but the court found the unit was the smallest taxable entity. Consequently, the financing fee recorded as income was correctly subject to Value-Added Tax under the relevant sections of the VAT Act.

Keskinäisen kiinteistöosakeyhtiön kiinteistössä olevat huoneistot
oli määritelty yhtiöjärjestyksessä ja vastike perittiin
huoneistokohtaisesti. Siten pienin yksikkö, josta
yhtiö voi hakeutua verovelvolliseksi, oli huoneisto. Kiinteistöosakeyhtiö
ei voinut hakeutua verovelvolliseksi tyhjillään
olevan kiinteistön osan luovuttamisesta osakkeenomistajalle
eikä sellaisten huoneistojen luovuttamisesta
osakkaalle tai verovelvollisille, joissa osa huoneistosta
oli tyhjillään.
Veron perusteeseen oli luettava rahoitusvastike, jonka yhtiö
kirjasi tuloksi.
