Kuntayhtymän yhtymävaltuuston puheenjohtajan päätöksestä,

jolla yhtymävaltuutettu oli väliaikaisesti pidätetty luottamustoimestaan

kuntalain 40 §:n nojalla, valitettiin

lääninoikeuteen ilman oikaisuvaatimusmenettelyä.

Lääninoikeus katsoi, että yhtymävaltuuston puheenjohtaja

oli voinut hallintomenettelylain 15 §:n nojalla päättää

pidättämisestä väliaikaisesti yhtymävaltuuston kokoukseen

saakka, vaikka kuulemista ei ollut ehditty suorittaa,

koska asian ratkaisemista ei voinut lykätä.
