Spousal housing allowance correctly excluded from patient fee calculation under social services fee act.
Legislator summary
AI generatedThe County Administrative Court allowed the patient's appeal against a health center's fee decision. The patient argued that the housing allowance received by their spouse should not have been deducted from their income when calculating the long-term care fee. The court found the fee was not incorrectly imposed because the law permits deducting spousal maintenance and similar family-related costs from the liable party's income. Consequently, the court upheld the original decision to include the spousal housing allowance in the income calculation.

Oikeuskysymyksenä oli, luetaanko puolison saama eläkkeensaajien
asumistuki hänen tulokseen pitkäaikaisen laitoshoidon
asiakasmaksua määrättäessä.
Terveyskeskus oli määrännyt pitkäaikaisessa laitoshoidossa
olevan henkilön asiakasmaksun siten, että puolison elatuksen
tarvetta laskettaessa hänen saamansa asumistuki otettiin
laskelmassa huomioon hänen tulonaan.
Asiakas valitti päätöksestä lääninoikeuteen mm. sillä perusteella,
että asumistukea ei oteta huomioon maksua
määrättäessä.
Lääninoikeus katsoi, että kun maksuvelvollisen tulojen vähennyksenä
otetaan huomioon suoritetut elatusavut ja
muut perhesuhteista johtuvat vastaavat kustannukset, ettei
maksua ollut määrätty virheellisesti.
