Ympäristölautakunnan rakennusjaosto oli myöntänyt rakennusluvan saunarakennuksen rakentamiseen. Rakennuspaikan viereisen kiinteistön omistaja oli valittanut rakennusjaoston päätöksestä. Rakennusjaosto on tämän jälkeen rakennuttajan hakemuksesta myöntänyt viimeksi mainitulle rakennusasetuksen 149 §:n mukaisen luvan saada aloittaa rakennustyö ennen kuin rakennuslupa on saavuttanut lainvoiman. Tällaisen ennakkoaloituslupahakemuksen hyväksymisen sisältävän päätöksen perusteleminen on ollut tarpeetonta, koska tällainen päätös ei koske hallintomenettelylain 24 §:n 2 momentissa tarkoitetulla tavalla toista asianosaista.
