Court dismisses temporary driving ban for single weed detector violation under Finnish Traffic Act.
Legislator summary
AI generatedThe Administrative Court of Vaasa dismissed the County Administrative Court's decision to revoke a temporary driving ban imposed for a single weed detector violation. The lower court found that the statutory requirements for such a ban were not met because the driver had not committed other offenses under the relevant section of the Traffic Act within the year. Consequently, the court ruled that the administrative authority lacked the legal basis to impose the restriction.

Oikeuskysymyksenä asiassa oli, voidaanko ajo-oikeuden haltija
määrätä määräaikaiseen ajokieltoon, kun tämä oli syyllistynyt
vuoden kuluessa ainoastaan yhteen tutkanpaljastinrikkomukseen.
A oli syyllistynyt 13.5.1994 tutkanpaljastinrikkomukseen.
Nimismies määräsi A:n ajokieltoon 1.8.-14.8.1994 väliseksi
ajaksi.
Lääninoikeus kumosi nimismiehen päätöksen ja katsoi, että
edellytyksiä määräaikaisen ajokiellon määräämiselle ei ollut,
koska A ei ollut vuoden sisällä muutoin syyllistynyt mainittuun
rikkomukseen tai muuhun tieliikennelain 75 §:n 2 momentin
5 kohdassa tarkoitettuun tekoon.
Tieliikennelaki 75 § 2 mom 5 kohta
