Court allows social assistance for home repair costs due to family's special needs and financial hardship.
Legislator summary
AI generatedThe Administrative Court of Lapland overturned the Social Board's rejection of a social assistance claim for home repairs caused by mold damage. The family, consisting of two adults and four children, faced severe financial hardship with debts exceeding 500,000 marks and income limited to unemployment benefits and home care support. The court ruled that these repair costs constituted special family needs under the Social Assistance Act, requiring the authorities to consider the full extent of the expenses when assessing the family's need for assistance.

Sosiaalilautakunta oli hylännyt T:n hakemuksen toimeentulotuen
saamiseksi perheen asuntonaan käyttämän omakotitalon
homevaurioista johtuviin noin 40 000 markan määräisiin korjauskuluihin,
koska perusparannuskustannukset eivät olleet
toimeentulotukeen oikeuttavia menoja.
Perheeseen kuului kahden aikuisen lisäksi neljä pientä lasta.
Perheellä oli velkaa noin 500 000 markkaa ja tuloina lähinnä
vain työttömyyspäiväraha ja kotihoidontuki. Kunnanhallitus
oli myöntänyt hyväksytystä 47 700 markan määräisestä kustannusarviosta
korjausavustusta enimmäismäärän eli 7 500 markkaa.
Vakuutus ei korvannut homevaurioista johtuvia vahinkoja.
Lääninoikeus katsoi, että näissä oloissa homevaurioista johtuvia
korjauskuluja oli pidettävä VNp:n 4 §:n 5 kohdassa tarkoitettuina
perheen erityisistä tarpeista tai olosuhteista
johtuvina menoina, jotka oli otettava tarpeellisen suuruisina
huomioon perheen toimeentulotuen tarvetta arvioitaessa.
