I haki omaishoidontukea 10.1.1994 päivätyllä ja vireille pannulla hakemuksella. Viranhaltijan päätös hakemukseen tehtiin 17.5.1994. Asiakirjojen mukaan hakemuksen ja päätöksen välisenä aikana ei tehty erityisempiä selvityksiä asian ratkaisemiseksi. Asiassa ei väitetty, että määrärahat puheena olevaan tarkoitukseen olisivat kokonaan loppuneet.

Lääninoikeuden päätöksen mukaan hakemusta ei näissä oloissa tullut hylätä määrärahan puutteeseen perustuen. Lääninoikeus kumosi lautakunnan päätöksen näillä ja eräillä muilla perusteilla ja palautti asian uudelleen käsiteltäväksi.
