Administrative court allows compensation claim for water supply obstruction covering pre-ownership period.
Legislator summary
AI generatedThe Administrative Court allowed the water authority's compensation claim regarding the obstruction of water supply, ruling that the claim must cover the period before the applicant acquired ownership. The court held that the water law provision and a Supreme Court precedent require compensation for the current owner even for periods prior to their acquisition of title. Consequently, the court immediately examined the portion of the claim relating to the time the land was not owned by the applicant.
