The Administrative Court of Uusimaa allowed the parent company to deduct a consortium subsidy despite the tax board's rejection. The tax board argued that since the subsidiary sold ongoing work to another firm mid-year, it ceased its own business operations, rendering the subsidy ineligible. However, the court found that the subsidiary retained responsibility for completing the unfinished work, meaning it continued to conduct business during the tax year. Consequently, the court ordered the tax authority to reconsider the deduction claim for the 1989 tax year.

Emoyhtiö oli antanut tytäryhtiölleen konserniavustuksen.

Tytäryhtiö oli verovuonna luopunut pääosin harjoittamastaan

urakoinnista myymällä alkavat työt toiselle yhtiölle.

Myynti oli tapahtunut tilikauden puolivälissä, mutta tytäryhtiölle

jäi keskeneräisten töiden lopppuunsaattaminen

ja vastuu niiden loppuun saattamisesta.

Verolautakunta oli katsonut, ettei takuuvelvoitteista vastaaminen

ollut enää konserniavustuslain tarkoittamaa liiketoimintaa,

minä vuoksi se ei hyväksynyt emoyhtiön verotuksessa

konserniavustusta vähennyskelpoiseksi.

Lääninoikeus katsoi toisin kuin verolautakunta, että konserniavustuksen

saaja, jota verovuonna oli verotettu liiketulosta,

oli verovuonna harjoittamut liiketoimintaa ja

kumoten valittajana olleen emoyhtiön verotuksen palautti

asian uudelleen käsiteltäväksi. Verovuosi_1989.
