Administrative court dismissed appeal regarding tax treatment of land sale at undervalue to family-controlled company.
Legislator summary
AI generatedThe administrative court dismissed the state's appeal against a lower court decision regarding the tax treatment of a land sale at an undervalue. The taxpayer sold land to a company in which he and his minor daughter held majority shares, arguing the transaction should be treated as a capital contribution rather than a taxable profit. The court upheld the lower court's ruling that the benefit received by the company constituted a capital investment for both the taxpayer and his daughter, thereby exempting the transaction from random profit tax under the relevant tax law section.

tarkoituksessa. Verovuosi 1988.
