Kysymys siitä, kuinka tilasta rakennuskaavatieksi osoitetun

ja siihen käyttöön korvauksetta luovutettavan maan

pinta-ala rakennuslain 104 §:n mukaan määritellään, käsiteltiin

lääninoikeudessa hallintoriita-asiana.

Tilan pinta-ala oli 3 250 neliömetriä. Tästä oli vanhastaan

käytetty tiemaana 250 neliömetriä, eikä maanomistajalla

ollut siltä osin rakennuslain 104 §:n 1 momentin

mukaan oikeutta saada korvausta. Mainitun pykälän 2 momentin

mukaan korvauksetta luovutettava kymmenesosa laskettiin

tilan koko pinta-alasta. Näin ollen rakennuskaavatieksi

korvauksetta luovutettava alue oli 250 neliömetriä

+ 325 neliömetriä.
