Yhtiön talouspäällikkönä toiminut verovelvollinen oli jäädessään
eläkkeelle saanut yhtiöltä lahjaksi taulun, josta
yhtiö oli maksanut 40 000 markkaa. Verolautakunta katsoi
lahjan kohtuulliseksi määräksi 20 000 markkaa ja lisäsi
jälkiverotuksin 20 000 markkaa verovelvollisen tuloon.
Verovelvollinen oli ollut 35 vuotta yhtiön palvelukessa.
Hän oli verovuonna saanut yhtiöltä yli 460 000 markkaa
palkkana, eläkkeenä ja muina veronalaisina etuuksina.
Lääninoikeus katsoi edellä mainittujen seikkojen ja lahjan
laadun perusteella sekä erityisesti sen johdosta, että
lahja oli annettu verovelvollisen eläkkeelle siirtymisen
yhteydessä, että lahjaa oli pidettävä kohtuullisena verovapaana
merkkipäivälahjana. Lääninoikeus kumosi jälkiverotuksen.
Verovuosi 1985.
