The Administrative Court dismissed the appeal against the Central Election Board's decision to reject a nomination request submitted by a parent on behalf of their daughter. The Board rejected the request because it was submitted without proper authorization, but the County Court had previously returned the case for re-examination due to a lack of procedural safeguards. The Court ruled that the Board violated the Administrative Procedure Act by failing to grant the appellant an opportunity to present the power of attorney or demonstrate that such a hearing was unnecessary.

Henkilö A oli oikaisuvaatimuksessaan keskusvaalilautakunnalle

vaatinut, että hänen Norjassa opiskeleva tyttärensä

B merkitään kunnan vaaliluetteloon. Keskusvaalilautakunta

jätti vaatimuksen tutkimatta, koska vaatimus oli esitetty

B:n puolesta ilman asianmukaista valtuutusta. Lääninoikeus

ei vahvistanut päätöstä vaan palautti asian keskusvaalilautakunnalle

uudelleen käsiteltäväksi, koska päätöksestä

tai sen perusteena olleista asiakirjoista ei ilmennyt,

että A:lle olisi varattu tilaisuus valtakirjan

esittämiseen tai että sen olisi todettu olleen hallintomenettelylaissa

tarkoitetuin tavoin tarpeetonta.
