The Administrative Court allowed the tax authority to treat the husband's share of the partnership income as his personal income for the 1987 tax year. Although the husband and wife operated a service station, the partnership company was not registered in the commercial register by the end of the tax year. The court ruled that because the entity did not exist as a separate taxable person at year-end, the income must be allocated to the partners according to their shares rather than treated as joint spousal business income.

Oikeuskysymyksenä asiassa oli, miten verotetaan puolisoiden

yhdessä kommandiittiyhtiön muodossa harjoittamaa liiketoimintaa,

kun yhtiötä ei ollut verovuoden päättyessä merkitty

kaupparekisteriin.

X oli harjoittanut yksityisliikkeenä huoltoasematoimintaa

1.10.1987 saakka, jolloin toiminta oli siirtynyt samana päivänä

perustetulle kommandiittiyhtiölle. Yhtiön vastuunalaisina

yhtiömiehinä olivat X ja hänen puolisonsa Y ja äänettömänä

yhtiömiehenä heidän täysi-ikäinen poikansa. Yhtiö oli merkitty

kaupparekisteriin 9.11.1988.

17 a §:n ja 17 b §:n 3 momentin säännöksiä.

tuloihin. Verovuosi 1987.
