Investment reserve deduction allowed despite late bookkeeping entry if investment payment was timely made.
Legislator summary
AI generatedThe administrative court allowed the foundation to deduct an investment reserve from its taxable income despite a procedural delay in bookkeeping entry. Although the foundation recorded the reserve after the two-month deadline set by the Bookkeeping Act, the court noted the reserve was established during the board meeting that approved the 1988 financial statements. The court ruled that because the actual investment payment was made within the statutory period, the procedural lapse did not deprive the foundation of its tax deduction right.

Liiketoimintaa harjoittanut säätiö oli tehnyt päätöksen investointivarauksen
muodostamisesta 31.12.1988 päättyneeltä
tilikaudelta 31.3.1989 pidetyssä säätiön hallituksen kokouksessa,
jossa myös vuoden 1988 tilinpäätös oli vahvistettu.
Säätiö oli kirjannut investointivarauksen kirjanpitoonsa
20.6.1989 eli kirjanpitolain 7 §:n 2 momentin vastaisesti
myöhemmin kuin kahden kuukauden kuluessa kalenterikuukauden
päättymisestä. Koska investointivaraus kuitenkin oli muodostettu
tilinpäätöksen vahvistamisen yhteydessä ja säädetyn
suuruinen investointitalletus oli tehty investointivarauslaissa
säädetyn määräajan kuluessa, lääninoikeus katsoi, että
säätiöllä oli edellä mainitusta laiminlyönnistä huolimatta
oikeus vähentää investointivaraus veronalaisesta tulostaan.
Verovuosi 1988.
