Court denies property income deduction for interest portion of pension loan repayment value.
Legislator summary
AI generatedThe Administrative Court dismissed the claim for a property income tax deduction regarding the interest component of a pension loan repayment value. The taxpayer argued for a deduction, but the court found that the repayment value was calculated using the insurer's internal rate rather than generating a specific interest claim. Consequently, the interest portion did not constitute taxable interest income eligible for the property income tax deduction under the relevant tax laws.

Oikeuskysymyksenä oli, oliko eläkevakuutuksen takaisinostoarvoon
sisältyvän korko-osuuden osalta myönnettävä omaisuustulovähennys.
Takaisinostoarvoa verovelvolliselle suoritettaessa siihen
sisältynyttä korko-osuutta ei erotettu pääomasta. Eläkekassan
sääntöjen mukaan vakuutuksen ottajalle ei syntynyt saamisoikeutta
tietynsuuruiseen korkoon sijoittamalleen pääomalle,
vaan takaisinostoarvo määritettiin käyttäen apuna vakuutusyhtiön
sisäistä, laskennallista korkokantaa.
Verovelvollisen suorittamat vakuutusmaksut ovat tulo- ja
varallisuusverolain 29 §:n 1 momentin 5 kohdan mukaan verotuksessa
vähennyskelpoisia ja niitä vastaava takaisinostoarvo
on tulo- ja varallisuusverolain 20 §:n 4 kohdan perusteella
säädetty kokonaisuudessaan veronalaiseksi. Tapauksessa
ei ollut kyse omaisuustulovähennykseen oikeuttavista veronalaisista
korkotuloista.
Verovuosi 1984.
