Legislator summary

AI generated

The Administrative Court allowed the taxpayer to deduct travel expenses between his residence and temporary work site without a personal share or upper limit. The taxpayer worked two daily shifts separated by over four hours at home, and the lower court had previously rejected these costs as living expenses. The court ruled that these journeys constituted temporary work trips under the Income Tax Act, making them fully deductible as income-derived expenses.

Saako maatalouslomittaja vähentää työjaksojen välillä lomitettavan

tilan ja asunnon välillä tehdyistä matkoista johtuneet

matkakustannukset täysimääräisinä ilman omavastuuosuutta

ja ilman ylärajaa.

A oli verovuonna työskennellyt maatalouslomittajana B:n ja

C:n kuntien palveluksessa. Työnantajat olivat maksaneet hänelle

asunnon ja lomitettavan tilan välisistä matkoista

matkakorvausta 4.846,56 markkaa. A:n päivittäinen työaika

elantokustannuksina.

Lääninoikeus katsoi, että A:n molemmista päivittäisistä työjaksoista

johtuneita matkoja oli pidettävä tilapäisesti

erityiselle työntekemispaikalle tehtyinä työmatkoina, joista

johtuneet matkakustannukset olivat tulo- ja varallisuusverolain

81 §:n nojalla tulon hankkimisesta johtuneina rajoituksetta

vähennyskelpoisia. A:lla oli siten oikeus vähentää

ko. matkakustannukset siltä osin kuin hän ei ollut

saanut niistä työantajiltaan verosta vapaaksi katsottavaa

korvausta.Verovuosi 1989
