Administrative court dismissed appeal; plaintiff failed to prove burden of proof shift regarding pumping station permit.
Legislator summary
AI generatedThe Administrative Court dismissed the plaintiff's appeal against the defendant's rejection of a compensation claim for fish death caused by a drying water pump station. The plaintiff argued that requiring a permit for the pump station would shift the burden of proof to the defendant, but the court held that the existence of a permit requirement did not alter the defendant's evidentiary obligations. Consequently, the court ruled that the plaintiff must still substantiate their claim independently, and the original decision remained in force.

VEO oli päätöksellään hylännyt kanteen kuivatusvesien pumppaamon
käytöstä johtuvan kalakuoleman korvaamisesta näyttämättömänä.
Kantaja haki muutosta väittäen, että pumppaamon luvan
tarve aiheuttaisi todistustaakan siirtymisen vastaajalle. Sen
vuoksi kantaja vaati pumppaamon luvantarpeen ratkaisemista
