Social security tax deduction for asset depreciation must exclude private use portion per tax declaration rules.
Legislator summary
AI generatedThe Administrative Court allowed the County Administrative Board's decision to adjust the 1991 social security tax by deducting only the statutory depreciation amount. The Board determined that the company's tax declaration correctly excluded the portion of depreciation attributed to the boat's private use from the total asset depreciation. Consequently, the court upheld the ruling that the taxable base must reflect only the legally prescribed depreciation figures, not the gross amount recorded in the company's books.
