The Administrative Court dismissed the appeal against a lower court's finding that the defendant drove without a license after his driving ban expired. The defendant had left the court premises immediately after the judgment but only had his license seized by police on a later date. The court ruled that the defendant was not guilty of driving without a license because he had not been formally notified of the ban's expiration or had his license removed from his possession.

Henkilö oli 5.9.1989 kihlakunnanoikeudessa tuomittu muun

muassa ajokieltoon, jonka viimeinen voimassaolopäivä oli

30.9.1989. Tuomion julistamisen jälkeen hän oli ajanut

autollaan pois käräjäpaikalta. Ajokortti oli otettu poliisin

haltuun vasta 18.9.1989.

Henkilön ei katsottu syyllistyneen ajokortitta ajoon ajokiellossa

ollessaan, koska häneltä ei ollut otettu ajokorttia

pois hallustaan eikä hänelle muutoinkaan ollut erityisesti

selvitetty ajo-oikeuden päättymisen alkamisajankohtaa.
