Administrative court allows deduction of construction costs for rental income under Finnish Income Tax Act.
Legislator summary
AI generatedThe Administrative Court of Finland allowed the taxpayer's request to deduct construction costs from rental income for tax years 1984 through 1987. The court found that the Income Tax Act did not explicitly require the deduction to be completed by the end of the tax year to remain valid. Consequently, the court ruled that the taxpayer's intent to claim the deduction was valid and ordered the case to be reconsidered by the tax board.

Oikeuskysymyksenä oli, voitiinko tulo- ja varallisuusverolain
mukaan verotettavan vuokratulon vähennykseksi vaatia vasta
valitusteitse rakennuksen hankintamenon poistoa.
Verovelvollinen oli saanut vuokratuloja omistamansa asuinrakennuksen
tiloja vuokraamalla. Hänen tuosta toiminnasta saamansa
puhdas tulo verotettiin tulo- ja varallisuusverolain
säännöksiä soveltaen. Mainituissa säännöksissä ei ole nimenomaisesti
edellytetty, että hankintamenon poistoa olisi vaadittava
säännönmukaisen verotuksen päättymiseen mennessä
seurauksin, ettei vaatimusta enää myöhemmin otettaisi huomioon.
Verovelvollisen ei myöskään ollut katsottava antamissaan
veroilmoituksissa esittäneen tahdonilmaisua siitä, ettei
hän tahtonut vaatia hankintamenon poistoa hyväkseen. Valituksessa
tehty rakennuksen hankintamenon poiston vähentämistä
koskeva vaatimus otettiin huomioon ja asia palautettiin verolautakunnalle
uudelleen käsiteltäväksi.
