Court allows deduction of social security contributions for silent partner despite non-receipt of company share.
Legislator summary
AI generatedThe Administrative Court ruled that a silent partner must pay social security contributions based on their contractual share in the limited partnership, even if they did not receive that share. The court held that the statutory calculation method requires contributions to be determined by the partner's defined portion in the company agreement. Consequently, the deduction of contributions solely because the silent partner failed to receive their allocated share was deemed legally incorrect.

Oikeuskysymyksenä asiassa oli, voitiinko kommandiittiyhtiön
äänettömälle yhtiömiehelle määrätä yhtiön veroäyrien perusteella
kansaneläke- ja sairausvakuutusmaksua, kun yhtiömies
ei todellisuudessa ollut saanut yhtiösopimuksen mukaista
osuuttaan.
Kansanelälain 5 §:n 2 momentin ja sairausvakuutuslain 34
§:n mukaan erillisenä verovelvollisena verotettavalle yhtymälle
määrätyistä veroäyreistä luetaan osakkaan vakuutusmaksun
perusteeksi se osa yhtymän veroäyreistä, joka vastaa
hänen osuuttaan yhtymässä. Säännöstä sovellettaessa katsotaan
kommandiittiyhtiö tässä tarkoitetuksi yhtymäksi. Maksuvelvollisen
