Oliko tilan omistaja velvoitettavissa rakentamaan liittymisjohto

yleiseen viemäriin.

Tilan A rakennus sijaitsi vahvistetun tonttijaon mukaisella,

vielä muodostamatta olevalla kaavatontilla nro 3, jonka kokonaisalasta

1.675 neliömetristä ko. tilaan kuului 1.485

neliömetriä muun osan kuuluessa S:n kaupungin omistamaan

tilaan B.

S:n terveyslautakunnan valvontajaosto oli velvoittanut Atilan

omistajan liittämään kiinteistönsä kunnalliseen viemäriverkostoon.

Lääninoikeus hyväksyi valituksen ja kumosi valvontajaoston

päätöksen. A-tilan omistajaa ei voitu velvoittaa liittämään

kiinteistöään yleiseen viemäriin, kun hän ei yksin

omistanut ko. tonttia.
