Legislator summary
AI generatedThe administrative court dismissed the secondary inheritance tax claim against the deceased's estate regarding assets inherited from another decedent. The court found that the original heir had already received the property via a will before dying, meaning the estate was not a recipient of secondary inheritance. Consequently, the tax authority's attempt to levy the tax was legally invalid.

Toimitettu verotus:
A oli 17.2.1983 kuolleen B:n kuolinpesän osakas. Sivuperinnön
verotusta ei ollut toimitettu, koska A ei ollut saanut
perintöä eläessään haltuunsa. A kuoli 24.8.1983. Hän oli
testamentannut koko omaisuutensa C:lle. B:n kuolinpesä jaettiin
28.6.1984. B:n kuolinpesästä tullut jako-osuus verotettiin
kunnallisverotuksessa vuodelta 1984 A:n kuolinpesän
saamana sivuperintönä.
Lääninoikeuden ratkaisu:
Perittävän omaisuus siirtyy hänen kuolinhetkellään hänen
perillisilleen. Näin ollen A:n omaisuus, johon sisältyi
myös hänen osuutensa B:n kuolinpesään, oli siirtynyt A:n
kuollessa C:lle. A:n kuolinpesä ei ollut sellainen B:n
kuolinpesästä tulleen omaisuuden saaja, jota voitiin verottaa
sivuperinnöstä. Sivuperinnön verotus poistettiin.
Verovuosi 1984.
