The Administrative Court allowed the municipality's claim for road maintenance fees, ruling that the property remained in the third fee class. Although the 1987 building plan permitted new road connections, the court found that traffic to the property historically and primarily occurred via a private path, not the public road. Consequently, the exemption condition regarding the lack of a new public road connection was deemed satisfied based on actual usage patterns rather than the updated zoning regulations.

Supreme Administrative Court dismissed appeal regarding wind farm zoning plan due to insufficient bear impact assessment. The court upheld the zoning plan's validity despite concerns about bear populations. The decision emphasizes that planning must be based on data available at the time of approval. The court found no grounds to alter the lower court's ruling on the zoning plan. The appeal was rejected because the environmental assessment was deemed sufficient based on existing conditions. The court ruled that future bear population changes do not invalidate the plan. The decision clarifies the timing of environmental impact assessments in zoning procedures. The court determined the zoning plan complied with legal requirements for environmental review. The appeal failed because the lower court correctly applied the relevant zoning laws. The court concluded that the zoning plan remains legally valid and enforceable.
